The Florida GOP and the billionaire Koch Brothers are waging an unprecedented attack on Florida’s Judiciary. This year, three excellent Supreme Court Justices are up for “merit retention” on the November 6 Ballot. Justices Lewis, Quince and Pariente are smart, honest and fair-minded jurists who happen to have authored opinions the GOP and the Koch brothers do not like.
 
This attack on the indepence of our Judiciary is a dispicable politicization of our legal system. We NEED a strong, independent Judicial branch of our government. If this effort succeeds, Governor Rick Scott will be able to “stack” the Florida Supreme Court with his hand-picked judges–we can all expect these individuals to be strongly anti-consumer.…

The Ruby Princess has, again, returned to port in Fort Lauderdale carrying sick passengers.
 
The Princess Cruise ship, which has had three reported outbreaks of norovirus so far in 2012, returned to port Sunday, March 11, 2012, from a weeklong Caribbean cruise with an unconfirmed number of sick passengers.
 
A week ago, the Ruby Princess returned to port with 129 sick passengers.
 
It has not yet been determined if this most recent incident involves the norovirus, or is an unrelated coincidence.

The House Civil Justice Committee got it right this year when they voted down the “Bad Faith Reform” bill (HB 427)sponsored by Rep. Kathleen Passidomo (R-Naples) 8-7. Three of the 8 “NO” votes were made by Republicans, who were evidently not convinced that doing away with Insurance Bad Faith was “business friendly” or consumer friendly, as it was touted.
 
Rep. Passidomo’s Bill represents the latest attempt by certain members of the Florida legislature to add restrictions to “third party” bad faith claims.
 
In the State of Florida, every insurance policy vests the right to settle (or not settle) a liability claim with the Carrier. However, if the Carrier decides not to resolve a claim when they can and should, or fails to protect their insured from a verdict in excess of the policy limits, they can be found guilty of “bad faith claims handling”, and forced to pay the judgment, even if it is in excess of policy limits.…

A measure intended to limit so-called “bad faith” lawsuits against insurance companies appears unlikely to pass during the 2011 session.
 
“Bad faith” lawsuits are filed against insurers that claim the company failed to financially protect policyholders and did not promptly settle liability claims. Business organizations and insurers have been pushing legislation this year that would set standards for bad faith claims as well limit attorney fees in cases involving motorist coverage.
 
A House subcommittee spent more than two hours on the bill Monday but Rep. Dennis Baxley was forced to temporarily postpone a vote on HB 1187 even after he amended the legislation.…
