There is nothing more horrifying to a parent or caretaker than seeing their child seriously injured or killed. As a society, we try to do everything in our power to protect our children from harm—yet accidents still happen at school, on the playground, in cars, and in a myriad of other locations. When a child is injured due to the negligence of a caretaker, facility manager, driver, or other third party, they may not be able to articulate what has happened, which is why their families need an experienced child injury attorney on their side. If your child is injured or killed due to the negligence of another in South Florida, let Lawlor, White & Murphey help. We’re a Fort Lauderdale law firm with years of experience representing both adults and children in personal injury cases. Our team is passionate and resolute when it comes to standing up for accident victims in our community, especially when those accident victims are children.
Common Types of Childhood Accidents
Car accidents are by far the most common cause of serious injuries to children. According to the most recent data available from the Center for Disease Control, 650 car passengers under the age of 12 died in car accidents in 2011, and more than 148,000 children under the age of 12 suffered injuries in crashes. Not wearing a seat belt is a major risk factor for being injured in a car accident, and 33% of children who died in a car accident in 2011 were not buckled in. Furthermore, 72% of car and booster seats are misused, increasing a child’s risk of being injured in a crash.
Other Common Causes of Children’s Accidents Include:
Premises liability. A child’s natural inclination is to explore the world around him or her, whether that’s the playground, their neighborhood, or even places they’re not supposed to be. Under Florida law, a property’s owner is not liable for injuries suffered by a trespasser – but there’s a different rule for children. The property owner may be liable for a child’s injuries if they fail to block off potential man-made hazards that children are known to play around, such as a swimming pool or a rusted car on blocks.
Premises liability doesn’t just apply to situations where a child wanders onto another’s property; it also comes into effect in accidents that take place in public places such as amusement parks, playgrounds, city swimming pools, school grounds, and day care facilities. The facility managers at these locations have a duty to maintain a reasonably safe environment for children, and if they fail to do so, they may be liable for injuries that occur on the property.
Defective products. Recalls for children’s products occur more frequently than you might think—the problem is that they’re not publicized widely enough. The Consumer Product Safety Commission maintains a database of current product recalls, but it’s unrealistic to expect parents to regularly check that database to ensure that none of their children’s products have recently been recalled. It is the manufacturer’s responsibility to make sure that their products are safe for use by children in the age range they are marketed to, and to inform parents if the product does cause any injuries. If your child has been injured or killed due to a poorly manufactured product, work with our Fort Lauderdale attorneys to take on the negligent manufacturer.
Drowning. In Florida, we have greater access to water than any other state, and our residents love spending time in the ocean, nearby lakes, rivers, and backyard pools. Sadly, we’re also the state with the highest drowning rate for children under the age of five. Children need constant adult supervision when they’re in the water, and if you lose a child because a lifeguard or other professional caretaker was not paying attention, you need to hold that person accountable for their negligence.
School bus crashes. School busses are designed to be safer than passenger vehicles, and they’re generally considered to be the safest way for children to get to and from school. That doesn’t mean that accidents never happen, though. On average, 24 children die every year as a result of a school transportation related accident, according to the Department of Transportation. A personal injury attorney can help parents determine who was at fault in a school bus accident and what can be done to ensure that this type of accident doesn’t happen again.
Dog bites. Young children are often unable to tell when a dog’s behavior means they shouldn’t go near. Children who are bitten by dogs also tend to sustain more serious injuries than adults who are bitten because they are often at face level with the attacking dog. Dog bites can cause permanent scarring and often make a child fear dogs for the rest of their life. If your child is bitten by a dog that was improperly restrained or allowed to run loose in the neighborhood, contact Lawlor, White & Murphey to learn what legal action you can take.
